Mobility Equipment Rental Agreement
This Mobility Equipment Rental Agreement (“Agreement”) is entered into between Apple Scooters Inc. (“Company”) and the individual or entity (“Renter”) signing or selecting the “I Agree to the Terms and Conditions” option.
By entering into this Agreement, Renter agrees to rent the mobility equipment, including but not limited to scooters, manual wheelchairs, electric wheelchairs, strollers, and transport chairs (“Equipment”), subject to the terms and conditions set forth below:
1. Ownership and Condition of Equipment
The Equipment is and shall remain the sole property of Apple Scooters Inc. and is provided to Renter in good working condition. Renter agrees to return the Equipment in the same condition as received, subject to normal wear and tear, at the end of the rental period for inspection and, if applicable, battery recharging. Apple Scooters Inc. may demand the immediate return of the Equipment, and Renter agrees to comply promptly. Apple Scooters Inc. reserves the right to repossess the Equipment without prior notice if used in violation of this Agreement.
2. Cancellation Policy
Renter may cancel the reservation with notice provided at least 72 hours prior to the scheduled delivery time, subject to a cancellation fee equal to $10 per unit. Cancellations within 72 hours to 24 hours of the scheduled delivery time will incur a cancellation fee of $50 per unit. Cancellations within 24 hours of scheduled delivery will be charged 2 day minimum charge per unit.
3. Rental Renewal
At the conclusion of the initial rental period, Renter may request to extend the rental at the original rental rates, subject to the same terms and conditions of this Agreement. Extensions are subject to Apple Scooters Inc.’s approval and Equipment availability.
4. Liability for Loss or Damage
Apple Scooters Inc. shall not be liable for any loss of or damage to property left, lost, stolen, stored, or transported by Renter or any other person using the Equipment, whether before or after its return. Renter assumes all risk of such loss or damage, waives all claims against Apple Scooters Inc. related there to, and agrees to indemnify, defend, and hold Apple Scooters Inc. harmless from any claims arising from such loss or damage.
5. Assumption of Risk
Renter assumes full responsibility and liability for any loss, damage, injury, or death to persons or property, including Renter’s own, arising from the use, operation, or possession of the Equipment.
6. Damage Waiver Policy
Apple Scooter offers a comprehensive damage waiver for all rental agreements, which absolves renters from liability for damages to scooters or strollers, up to a maximum of $500. This waiver applies to damages caused by the renter or third parties during the rental period. Please note that this waiver does not cover loss or theft of the equipment.
7. Responsibility for Equipment
Renter is responsible for the care and safekeeping of the Equipment during the rental period. In the event of loss, theft, or destruction of the Equipment, Renter agrees to reimburse Apple Scooters Inc. for the full replacement cost, as follows: $1500.00 for a scooter, $500 for a manual wheelchair or stroller, or the actual cost of replacement for other Equipment. Renter authorizes Apple Scooters Inc. to charge the credit or debit card provided for any replacement costs.
8. Usage Restrictions
The Equipment shall not be used, operated, or driven by any person: a) Under the age of 18; b) Under the influence of alcohol, drugs, or other intoxicants; or c) In a reckless, negligent, or unsafe manner. These restrictions are cumulative and apply to all uses of the Equipment.
9. Indemnification
Renter shall indemnify, defend, and hold harmless Apple Scooters Inc., its agents, officers, and employees from any and all claims, losses, liabilities, damages, injuries, demands, or actions arising from the use, operation, or possession of the Equipment, except where such loss or damage is caused by Apple Scooters Inc.’s gross negligence or willful misconduct.
10. Costs and Expenses
Renter shall bear all costs and expenses, including reasonable legal fees, arising from the use, operation, or possession of the Equipment.
11. No Liability for Acts of Renter
Apple Scooters Inc. assumes no liability for any acts or omissions of Renter or Renter’s agents, employees, or representatives.
12. Renter’s Obligations
Renter shall ensure that the Equipment is operated with reasonable care and in compliance with this Agreement. Renter shall promptly notify Apple Scooters Inc. of any accidents, damage, or incidents involving the Equipment.
13. Collection and Enforcement Costs
Renter agrees to pay all costs, expenses, and reasonable attorney’s fees incurred by Apple Scooters Inc. in collecting sums due, regaining possession of the Equipment, or enforcing any claims or damages against Renter under this Agreement.
14. No Agency Relationship
Neither Renter nor any operator of the Equipment shall be deemed an agent, employee, or representative of Apple Scooters Inc. for any purpose.
15. Joint and Several Liability
Any individual executing this Agreement on behalf of an entity or in a representative capacity shall be personally liable, jointly and severally, with such entity for all obligations under this Agreement.
16. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Credit and Debit Card Policies
Apple Scooters Inc. accepts major credit cards and debit cards for payment, security deposits, and credit identification at the time of rental.
If Renter fails to return the Equipment as agreed, Apple Scooters Inc. may obtain additional authorizations from Renter’s account to cover rental charges and the replacement value of the Equipment. Apple Scooters Inc. is not responsible for any fees, including overdraft or returned check fees, incurred due to this policy.
Positive identification, in addition to a valid driver’s license, may be required. Prepaid debit or gift cards are not accepted for credit identification or security deposits but may be used for payment at the time of return.
No-Show Policy
To ensure availability for all customers, Renter must cancel any unneeded reservation at least 24 hours prior to the scheduled delivery time. Failure to cancel within 24 hours or failure to accept delivery of the Equipment will result in a cancellation fee equal to 2 day minimum charge.
Rental Extensions
The Equipment is due for return on the date and time specified in this Agreement. To extend the rental period, Renter must contact Apple Scooters Inc. prior to the expiration of the rental term. Extensions are subject to Apple Scooters Inc.’s approval and Equipment availability.
Battery Maintenance
The Equipment is provided with a fully charged battery at the time of delivery. Renter is responsible for charging the battery as needed during the rental period. In the event Renter requires a replacement battery due to failure to charge, Apple Scooters Inc. may deliver a fully charged battery for a fee of $45 during business hours.
